Terms of Service

The terms and conditions for using ClaimCheck.

Effective Date: January 24, 2026

These Terms of Service ("Terms") govern your access to and use of the ClaimCheck platform and services provided by Beach Plain Unlimited, LLC ("ClaimCheck", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using ClaimCheck, you agree to these Terms and our Privacy Policy. If you are using ClaimCheck on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

ClaimCheck is a billing intelligence and claims management platform designed for independent adjusting firms. Our services include:

  • Claims tracking and management
  • Invoice and billing management
  • Carrier payment analytics
  • Document storage and organization
  • Voice-assisted data entry
  • Reporting and dashboards

3. Account Registration

To use ClaimCheck, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activity under your account

4. Subscription and Payment

4.1 Fees

ClaimCheck is offered on a per-seat subscription basis. Current pricing is available on our Pricing page. We reserve the right to change pricing with 30 days notice.

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.3 Beta Program

Beta participants may receive special pricing terms as specified in their individual agreements. Beta pricing is locked for the duration specified in the beta agreement.

5. Your Data

5.1 Ownership

You retain all rights to the data you upload to ClaimCheck. We do not claim ownership of your business data, documents, or other content.

5.2 License to Us

You grant us a limited license to use your data solely to provide and improve our services. This includes processing, storing, and displaying your data as necessary to operate the platform.

5.3 Data Export

You may export your data at any time using the export features in the platform. Upon account termination, we will provide a reasonable period to export your data before deletion.

6. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or attempt to compromise system security
  • Share account credentials with unauthorized users
  • Use the service to store or transmit illegal content
  • Attempt to reverse engineer or copy the platform
  • Resell or redistribute the service without authorization

7. Intellectual Property

ClaimCheck and its original content, features, and functionality are owned by Beach Plain Unlimited, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform or branding without written permission.

8. Third-Party Services

ClaimCheck may integrate with third-party services. Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party providers.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance or updates that temporarily affect access. We will provide reasonable notice for planned downtime when possible.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ClaimCheck is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
  • We are not responsible for data loss caused by your actions or third-party services

11. Indemnification

You agree to indemnify and hold harmless Beach Plain Unlimited, LLC from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

12. Termination

12.1 By You

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

12.2 By Us

We may suspend or terminate your account for violation of these Terms, non-payment, or other reasonable cause with notice.

12.3 Effect of Termination

Upon termination, your right to use the service ends. You will have 30 days to export your data before it is deleted.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Texas.
